Job Title Legal Manager (Recovery & Resolution)
Department Legal Collections
Recovery & Resolution is responsible for managing and executing
legal recovery actions for delinquent, non-performing asset (NPA),
and written-off loan accounts of the Housing Finance Company.
The role focuses on maximizing recovery through legal remedies,
enforcement actions, settlement negotiations, litigation
management, and coordination with internal stakeholders, external
advocates, recovery agencies, and regulatory authorities.
The incumbent shall ensure compliance with applicable laws
including SARFAESI Act, DRT proceedings, Insolvency laws,
Civil and Criminal remedies, and RBI/NHB regulatory guidelines
while driving effective recovery strategies.
1. Key Responsibilities
Recovery Management of NPA & Written-Off Accounts
Handle recovery of defaulted housing loan, LAP (Loan Against
Property), and other secured loan accounts classified as NPAs or
written off.
Formulate account-wise recovery strategies based on borrower
profile, security value, litigation status, and recovery feasibility.
Monitor overdue and delinquent accounts to initiate timely legal
action.
Ensure recovery targets are achieved through legal interventions
and negotiated settlements.
Conduct periodic review of high-value stressed accounts and
recommend appropriate legal recovery mechanisms.
2. SARFAESI Proceedings
Initiate and manage proceedings under the SARFAESI Act.
Draft, vet, and issue:
Demand Notices under Section 13(2)
Possession Notices under Section 13(4)
Sale Notices and Auction Notices
Coordinate and obtain symbolic and physical possession of secured
assets.
Liaise with advocates/agencies for obtaining Sec. 14 orders for
possession from the District Magistrate/Chief Metropolitan
Magistrate.
Supervise property auctions and ensure compliance with statutory
timelines and procedures.
Resolve objections/representations submitted by borrowers under
SARFAESI provisions.
3. Litigation & Court Management
Manage litigation before:
DRT (Debt Recovery Tribunal)
DRAT
Civil Courts
High Courts
NCLT/NCLAT
Consumer Forums
Criminal Courts
Coordinate with empaneled advocates for drafting, filing,
appearances, and follow-up of cases.
Review legal pleadings, affidavits, written statements, rejoinders,
and petitions.
Track case progress and maintain litigation MIS.
Ensure timely filing of replies, evidence, and compliance
documents.
Issue legal notices and reply to legal notices received from
customers/third parties.
4. Recovery Through Negotiation & Settlements
Negotiate settlements, restructuring proposals, and One-Time
Settlement (OTS) arrangements with borrowers.
Evaluate settlement proposals considering recoverability, legal risk,
and business impact.
Facilitate execution of settlement agreements and monitor
compliance with payment schedules.
Recommend compromise settlements for approval as per company
policy.
5. Asset Possession & Enforcement
Coordinate and ensure repossession and enforcement actions
through authorized officers and recovery agencies.
Ensure legal compliance during possession and auction
proceedings.
Coordinate valuation, publication, and sale of secured assets.
Address borrower resistance, police coordination, and enforcement
support where required.
Additional Responsibilities
Management of fraud recovery cases
Handling skip-tracing and difficult recovery matters
Vendor and advocate empanelment
Recovery policy drafting and updates
Team management and training
Participation in recovery camps and settlement drives
6. Coordination & Stakeholder Management
Coordinate with:
Collections teams
Credit teams
Operations departments
External advocates
Recovery agencies
Auctioneers
Government authorities
Provide legal guidance to branch and recovery teams on stressed
asset management.
Support audit, vigilance, and regulatory inspections related to
recovery matters.
7. MIS & Reporting
Prepare and present:
Recovery status reports
Litigation trackers
SARFAESI action status
Ageing analysis
Recovery forecasts
Legal recovery dashboards
Maintain database of court cases, notices, possession status, and
auction outcomes.
Analyze recovery trends and suggest process improvements.
Updating the litigation details and details of all legal actions as per
the prevailing system.
Key Performance Indicators (KPIs)
Recovery amount achieved from NPA and written-off accounts
Resolution rate of delinquent accounts
Number of SARFAESI actions completed
Reduction in legal ageing of cases
Success rate in litigation matters
Timeliness of legal action initiation
Settlement closure efficiency
Compliance adherence and audit observations
Contract Duration As stated in contract

Experience required
5–12 years of experience in:
Legal recovery Banking/HFC/NBFC collections litigation
SARFAESI proceedings DRT and secured asset enforcement Prior
experience in Housing Finance Company, Bank, NBFC, or ARC is a
must.
